A police hold can stop an impounded vehicle from being released even when your company owns the vehicle, has the correct paperwork, and is prepared to pay the tow and storage charges.

For rental companies, fleet operators, insurers, lenders, leasing companies, dealerships, and rideshare fleets, the key is finding out exactly which agency controls the vehicle and what is preventing release.

What Is a Police Hold?

A police hold generally means a law enforcement agency has placed restrictions on the release of a vehicle.

The tow yard may physically possess the vehicle, but that doesn't necessarily mean the tow yard has authority to give it back.

California Highway Patrol makes this distinction clear. CHP says vehicles classified as impounded require a release from the CHP office responsible for the impound. The towing company cannot release the vehicle until CHP directs it to do so.

For your fleet, this means paying the tow bill alone may not solve the problem.

Why Would Police Place a Hold on a Vehicle?

The reason depends on the incident and the legal authority used.

A vehicle may be held in connection with:

Criminal investigation

Evidence Holds Are Different

An evidence hold can create a much different recovery problem.

California Vehicle Code Section 22655.5 allows law enforcement to seize a vehicle under specified circumstances when officers have probable cause to believe the vehicle was used in a public offense, is itself evidence of a crime, or contains evidence that cannot readily be removed.

CHP has separate procedures governing vehicles stored as evidence under this authority or under a search warrant.

In an evidence case, your rental or fleet company may own the vehicle but still be unable to recover it immediately.

Ownership doesn't automatically override the investigation.

First Find Out Which Agency Controls the Hold

Don't start with the tow yard.

Start with the agency.

That could be:

California Highway Patrol
City police department
County sheriff
Another law enforcement agency

Ask the tow facility which agency ordered the impound if your company doesn't already know.

CHP advises owners who don't know why or where their vehicle was towed to contact the office responsible for the tow.

You need the agency controlling the hold before you can work on the release.

Ask What Type of Hold Exists

"Police hold" isn't specific enough.

Your fleet team needs to know what the agency is actually requiring.

Ask:

What authority is the vehicle being held under?

Is the vehicle being held as evidence?

Is there a fixed impound period?

Is the vehicle eligible for early release?

Does an investigator need to approve release?

Has the vehicle examination been completed?

What must the registered or legal owner provide?

Getting a specific answer helps your team determine the next step.

Rental Car Under a Police Hold

Rental vehicles create a difficult situation because the company that owns the car may have had nothing to do with the incident.

A customer rents the vehicle.

Someone gets arrested.

Police impound the car.

The customer stops responding.

Your rental company still owns an income-producing asset sitting in storage.

The first priority is determining the statutory basis for the impound and the vehicle's current release status.

Don't assume the renter has to solve it.

Don't assume the rental company can immediately retrieve it either.

Find out what type of hold exists.

Fleet Vehicle Under Investigation

Commercial vehicles can become involved in incidents far from your corporate office.

A driver may be involved in an accident or investigation.

The vehicle gets towed.

Corporate fleet management learns about it later.

Now your company needs to establish:

Vehicle location
Impounding agency
Case or incident number
Reason for hold
Investigating officer or unit, when available
Registered owner
Legal owner or lienholder
Release status
Documentation requirements
Recovery options

The tow yard may not be able to resolve the law enforcement side of the case.

Can the Registered Owner Get a Police-Held Vehicle Released?

Sometimes, but ownership alone doesn't guarantee immediate release.

CHP procedures state that release of an impounded vehicle depends on the statutory requirements associated with the specific removal or impound authority.

When release becomes available, CHP procedures may involve documentation such as:

Current registration
Ownership papers
Driver's license information
Court documents
Proof of insurance
Agent authorization

If an agent's authority is questioned, CHP procedures allow for requesting notarized written certification from the registered or legal owner.

Corporate Ownership Doesn't Automatically Clear the Hold

This matters for rental and fleet operators.

Your registration might clearly show:

ABC Fleet Holdings LLC

That proves an ownership connection.

It doesn't necessarily give the tow yard permission to disregard a law enforcement hold.

Treat these as separate questions:

Can we prove ownership?

and

Has law enforcement authorized release?

You may need both resolved before pickup.

What About a Vehicle Held as Evidence?

Evidence holds require particular care.

CHP policy states that vehicles can be seized as evidence under California Vehicle Code Section 22655.5 or under a search warrant. Its evidence procedures focus on preserving the vehicle and evidence until the investigative purpose has been addressed.

For a commercial owner, ask the investigating agency:

Is the entire vehicle still required?
Has the vehicle examination occurred?
Is release authorization pending?
Who has authority to approve release?
Is there anything the registered owner needs to submit?

Avoid repeatedly sending people to the tow yard while the vehicle remains under investigative control.

Police Hold vs. Tow-Yard Hold

These are different problems.

Police Hold

Law enforcement controls the release.

The tow company may be unable to release the vehicle until the agency authorizes it.

Tow-Yard Release Requirement

The agency may have cleared the vehicle, but the tow facility still needs applicable ownership documents, authorization, identification, and payment.

Your recovery process needs to identify which problem you're dealing with.

Sometimes you have both.

Police Release Doesn't Mean the Vehicle Is Free to Pick Up

Getting the police hold removed is a major step.

But you're not necessarily finished.

The tow facility may still require:

Release paperwork
Ownership documentation
Company authorization
Identification
Applicable towing charges
Storage charges
Pickup authorization

Your company also needs to determine if the vehicle can safely and legally be driven.

Confirm everything before dispatch.

Storage Costs During a Police Hold

Storage expenses can become a major concern for fleet owners.

Ask early:

Who is responsible for towing charges?
Who is responsible for storage?
When did storage begin?
What is the daily storage rate?
Is the vehicle being stored under an evidence contract?
When did the agency authorize release?
When was your company notified?

Do not assume the answer is the same for every police hold.

CHP maintains separate policies for evidence impounds, including procedures related to evidence tow contracts and financial responsibility.

Post-Storage Hearing Rights

Some California law enforcement impounds have a post-storage hearing process.

For CHP cases, the registered owner, legal owner, or their agent can request a hearing to determine the validity of the storage or impound.

Current CHP procedures state that the request generally needs to be made within 10 days of the date appearing on the notice.

A post-storage hearing isn't the same thing as automatically clearing an evidence hold.

The type of impound and statutory authority still matter.

If your company intends to challenge an impound, pay attention to the deadline.

Insurance Vehicles With Police Holds

Insurance companies often encounter police holds after:

Serious collisions
Theft recoveries
Suspected fraud
Hit-and-run incidents
Criminal investigations

The insurer may need to inspect or move the vehicle, but law enforcement may still control access or release.
