NYC Company Vehicle Recovery

Corporate vehicles need special attention because the person retrieving the vehicle usually isn't the registered owner.

NYC's current guidance specifically addresses company vehicles. For certain NYPD and Sheriff or Marshal recoveries, a person retrieving a company vehicle may need a valid driver's license, company identification, and vehicle keys. Requirements depend on the type of tow.

NYC states that a Sheriff or Marshal boot can be placed on a vehicle when more than $350 in qualifying parking or camera violations are in judgment. The City also notes that any vehicle registered to the debtor may potentially be booted, even if that particular vehicle didn't receive the original tickets.

That makes centralized ticket management important for fleets with multiple vehicles registered under the same corporate entity.

One vehicle's violations can create problems elsewhere in your fleet.

Rental Car Impounded in New York City

Rental vehicles create another issue.

The customer may have:

• Parked illegally
• Accumulated violations
• Been arrested
• Driven without required documentation
• Been involved in an accident
• Abandoned the vehicle
• Left New York

Your company still owns the asset.

A vehicle connected with an arrest or investigation may go through an NYPD Auto Pound rather than an ordinary tow pound.

NYPD advises owners to contact the Auto Pound before traveling there to confirm the vehicle is available and determine what paperwork is required. A vehicle may still be needed as arrest evidence.

Don't dispatch a transporter until the hold status is confirmed.

Storage Adds Up While Departments Wait

For regular NYPD Tow Pound vehicles, NYPD currently lists:

• Regular tow: $185
• Heavy-duty tow: $370
• Overnight storage: $20

Storage applies for each night the vehicle remains at the Tow Pound after the tow date.

Sheriff and Marshal towing uses a different fee structure, with rates varying based on vehicle weight and other factors.

For a commercial fleet, however, the city fee isn't your complete cost.

Auction Risk Requires Immediate Attention

This is one of the biggest reasons not to leave a fleet vehicle sitting.

NYC says a vehicle towed by a Marshal or Sheriff should be reclaimed within 10 business days. The City also advises requesting a Sale Hold within 72 hours if applicable. Otherwise, the vehicle may be auctioned by the Sheriff's Office.

NYC's Department of Finance separately warns that a qualifying vehicle may be auctioned as soon as 10 days after the tow.

For a fleet, an auction warning should trigger immediate escalation.

Don't treat it like another tow invoice.

Lienholder and Titleholder Recovery

NYC also provides a process for financial institutions holding title or liens on booted or towed vehicles.

The lienholder must establish its legal standing through supporting documentation. Once approved, the Department of Finance can issue a Notice to Release that is also provided to the Sheriff or Marshal restraining the vehicle.

This can matter for:

• Fleet lessors

Identify the legal owner early instead of waiting until the vehicle approaches auction.

Predatory and Excessive Towing Concerns

Not every expensive NYC tow is predatory. City-imposed fees, judgment debt, storage, boot charges, execution fees, and other authorized costs can create a large total.

But fleets should still review unexplained charges from private contractors or third-party recovery providers.

Watch for:

• Charges outside agreed rates
• Duplicate towing
• Unsupported GOA charges
• Unnecessary secondary towing
• Unauthorized subcontracting
• Unexplained storage
• Release delays
• Vague invoices
• Vehicle taken to an unexpected destination

Request an itemized invoice and compare it with the dispatch record.

A towing company possessing the vehicle doesn't automatically mean every invoice line should be approved.

Don't Confuse a Relocation With an Impound

NYC sometimes relocates vehicles instead of impounding them.

The City says vehicles can be moved to nearby locations because of accidents, construction, filming, parades, fairs, and other street events. If a vehicle was relocated, the local precinct may be able to help locate it.

This matters when telematics shows the vehicle nearby but your driver reports it missing.

Before opening a theft or impound recovery case, determine if NYPD simply relocated it.

Out-of-State Fleet Vehicles

NYC fleet impounds frequently involve vehicles registered elsewhere.
